Pussy Riot will Serve 2 Years in Prison, Over 1 Year at Labor

This afternoon Moscow time Nadezhda Tolokonnikova, Maria Alyokhina and Ekaterina Samutsevich were sentenced to two years in a labor camp because they sang for 30 seconds in church.

It is a new low in Russian barbarism.

The trio will serve their time starting March 4, 2012 (Russian-language link) and get double credit for each day of pretrial detention, meaning that just over 1 year will be at labor. The sentence was imposed for their “crime” of “hooliganism” and “homosexual propaganda.”

Everyone knows that if they had been singing Putin’s praises, they would not be going to a labor camp. To the contrary, the’d probably be featured on national TV and get a record contract.

Everyone knows that if they had been singing in a mosque, synagogue or protestant temple, they would never been been arrested.  Nobody would have cared.

But because they appeared in an Orthodox Church and criticized Putin, they do two in prison.  This includes two mothers with young children.

Just a few months ago, idiotic MSM journalists like Miram Elder and Julia Ioffe were breathlessly reporting that Russia had been “changed forever” by the protest demonstrations organized by Alexei Navalny. Now, not only have those protests entirely dissipated but Navalny himself is on his way to prison, maybe a cell right next to Pussy Riot or Mikhail Khodorkovsky.

Russia has not changed. The vast majority of Russians will not bat an eyelash at the incarceration of these young artists, who now must spend what will seem to them to be a lifetime behind bars.  Indeed, many will cheer.  Hardly any will go to the streets to demand justice.

And so Russia’s fate is sealed. It will go the way of the USSR.

NOTE:  This post has been revised to indicate that the trio will serve a total of about 1.5 years years in prison, one at labor, not two-and-a-half  years total with two at labor as originally reported. It appears that Pussy Riot will get credit for two days [Russian-language link] of sentence time for each day of pretrial detention, so in fact they only need to serve a little over one more year behind bars, assuming no parole.

              Actually we just learned is even better, because they will get two days of credit for each pretrial detention day. So they should be out in late 2013. Conveniently they will avoid being in prison for Sochi games.

                Two days of credit for each pretrial day rule is only applicable in case of pretrial home confinement. Since Tolokonnikova et.al. were kept under arrest they have one day per day.

The time of custody pending the trial shall be counted in terms of deprivation of liberty, service in a disciplinary military unit, or arrest at the rate of one day for one day, of restraint of liberty at the rate of one day for two days, of corrective labour and restriction in military service at the rate of one day for three days, and the time of compulsory works at the rate of one day of custody for eight hours of compulsory works.

                    Restraint of liberty = 1 day for 2 days.

                    In terms of russian code:
                    Deprivation of liberty means jail.

                    Restraint of liberty means no jail. It means home arrest or electronic monitoring.

                    They will absolutely have one day for one day. There is no doubt about that.

    An objective look at another “protest” that’s gone far too far and should meet with a really harsh penalty.

    I have just visited the blog called http://www.englishrussia.com (one of my favourites) and there is a report about another group of crazy feminists FEMEN destroying the cross (a Catholic one) in Kiev dedicated to the victims of WW2.

    In the past I used to sympathise mildly with the group’s objective of protecting sexually exploited women in the countries of former Soviet block albeit rejecting their methods of protest.

    The above mentioned act has destroyed any shred of the positive feelings that I’ve held for them.

    I can only hope that the Ukrainian authorities will deal with this act of an incomprehensible vandalism accordingly as it is much worse and barbaric of anything the Pussy Riot has done.

    My outrage has nothing to do with the fact that the cross is a Catholic one. It would be as relevant if it was any Orthodox religious symbol, of course.
